The role of a Chapter 13 trustee is both legal and administrative in nature and is outlined in the Code under 11 USC 1302. On receiving assignment of the case, the trustee will begin receiving the debtor’s payments and the creditors’ claims to be processed. Disbursements by the trustee preconfirmation will be limited to adequate protection payments governed by the local bankruptcy rule or by order of the court. All other disbursements will begin following confirmation of the plan. A trustee acts as an administrative arm of the court in its review of the debtor’s schedules and plans for accuracy and compliance with the Bankruptcy Code and federal and local rules requirements. A trustee presides over the first meeting of creditors of the debtor under 11 USC 341 and is required to make specific inquiries of the debtor concerning the information provided and attested to by the debtor in the schedules filed with the court. After a full review of the case and the debtor’s testimony, a trustee may file formal objections to the confirmation of the debtor’s plan to address any perceived errors or failures to comply with the Code and procedure.
A trustee has a responsibility to advise and assist the debtor in performance under the plan, except as to any legal matters. A trustee may not provide legal advice to either debtors or creditors in Chapter 13 matters. A debtor will have direct contact with the trustee’s office regarding only administrative case matters and will require the services of his or her counsel to address most issues that affect performance under the plan.
